  1. ASYMETRIX NEURON PLUG-IN SOFTWARE LICENSE AGREEMENT

  3. BY USING THE ASYMETRIX NEURON PLUG-IN SOFTWARE, YOU ACCEPT THE TERMS OF THIS
  4. AGREEMENT. IF YOU DO NOT ACCEPT THE TERMS OF THIS AGREEMENT DO NOT USE THE
  5. ASYMETRIX NEURON PLUG-IN SOFTWARE AND DELETE IT FROM YOUR COMPUTER.

  7. License and Copyright. Under this license you may download and use the
  8. Asymetrix Neuron Plug-In Software ("Software") on as many computers as you
  9. like in connection with a world wide web home page or server and you may
  10. permit the Software to be downloaded free of charge from your world wide web
  11. page or server for use subject to this license. You may not: (i) modify,
  12. translate, or merge the Software; (ii) reverse-engineer, disassemble, or
  13. decompile the Software (except to the extent expressly permitted by the
  14. application of local copyright law whose exclusion is precluded); or (iii)
  15. transfer, sublicense or lease the Software except as provided in this
  16. agreement, but you may identify or provide a link to the Asymetrix URL where
  17. the software may be download directly. The Software is protected by
  18. copyright laws and must be treated like any other copyrighted material.

  20. DISCLAIMER OF WARRANTY. THIS SOFTWARE IS PROVIDED FREE OF CHARGE. THEREFORE,
  21. ASYMETRIX AND ITS SUPPLIERS EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES (OR
  22. CONDITIONS), EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED
  23. WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND
  24. NONINFRINGEMENT. THE SOFTWARE IS PROVIDED "AS IS."

  26. LIMITATIONS OF LIABILITY. ASYMETRIX AND ITS SUPPLIERS ARE NOT LIABLE FOR ANY
  27. DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES,
  28. EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, WHETHER SUCH DAMAGES
  29. ARISE FROM CLAIMS BASED UPON CONTRACT, WARRANTY, TORT OR OTHERWISE.

  31. Some jurisdictions do not allow limitation or exclusion of incidental or
  32. consequential damages, so the above limitation or exclusion may not apply to
  33. you to the extent that liability is by law incapable of exclusion or
  34. restriction.

  36. General. This agreement constitutes the final and entire agreement between
  37. you and Asymetrix. It may only be modified by written agreement by an
  38. authorized Asymetrix representative. Asymetrix may obtain an injunction to
  39. prevent the breach of this agreement. This agreement is governed by the
  40. internal laws of the State of Washington, U.S.A., and specifically excludes
  41. the United Nations Convention on Contracts for the International Sale of
  42. Goods.
